The reasons for divorce are listed in the Turkish Civil Code as general reasons and special reasons, and the spouses can proceed with contested or uncontested (consensual) divorce cases.

In order for uncontested (consensual) divorce cases to be filed, the marriage union between the parties must have lasted for at least one year, and the parties must agree on divorce and financial matters which are the natural consequences of the divorce. In uncontested divorce cases, a protocol containing the agreed financial matters regarding the divorce is prepared and presented to the court. In this process, it is very important for the parties to conduct their negotiations through a lawyer in order to fully protect their rights.

In contested divorce cases, the parties cannot reach an agreement on the issues related to the divorce. For this reason, the court will decide on the disputed issues between the parties by evaluating the evidence presented in the court and witness statements. In the judicial process, in addition to the divorce and marital breakdown, the issues of alimony, custody, pecuniary and non-pecuniary compensation are also resolved. In addition, a separate lawsuit should be filed in order to determine how the property will be divided among spouses after the divorce case.
